Terms of Service
1. Purpose and Acceptance
These Terms of Service govern access to and use of the Ganima platform (hereinafter, the "Service"). By accessing and using the Service, you fully and unreservedly accept all terms set out herein. If you do not agree with any of these terms, please do not use the Service.
2. Service Description
Ganima is an automated demonstration platform powered by artificial intelligence agents, offering:
- Interactive AI demos: an AI agent connects with your leads via video call, showcases your product in real time, answers questions, and adapts the presentation to each participant.
- Automatic lead qualification: the agent evaluates each lead's interest and profile during the demo.
- Meeting scheduling: automatically schedules meetings with your sales team after the demonstration.
- CRM integration: synchronization with platforms such as HubSpot, Salesforce, Dynamics 365, and others.
- Global availability: 24/7 operation in multiple languages and time zones.
3. Registration and User Account
To access the Service, you must create an account by providing truthful, complete, and up-to-date information. You are responsible for:
- Maintaining the confidentiality of your access credentials.
- All activities carried out under your account.
- Immediately notifying Ganima of any unauthorized use of your account.
Ganima reserves the right to suspend or cancel accounts that violate these terms.
4. Acceptable Use
Users agree to use the Service lawfully and in accordance with these terms. The following are expressly prohibited:
- Using the Service for illegal or unauthorized purposes.
- Attempting to access systems, data, or other users' accounts without authorization.
- Interfering with the operation of the Service or its infrastructure.
- Reproducing, duplicating, copying, selling, or reselling any part of the Service without express authorization.
- Using the Service to send unsolicited communications (spam).
- Sharing content that is defamatory, obscene, fraudulent, or that infringes third-party rights.
- Reverse engineering, decompiling, or disassembling any component of the Service.
5. Intellectual Property
All intellectual and industrial property rights in the Service, including but not limited to its design, source code, logos, trademarks, trade names, text, images, graphics, and software, are owned by Ganima or its licensors.
Use of the Service does not grant the user any license or ownership rights over such elements beyond the limited right of use in accordance with these terms.
Content uploaded or generated by the user through the Service (such as demo configurations) remains the property of the user, granting Ganima a limited license to process it for the purpose of providing the Service.
6. Recordings and Demo Content
Demonstrations conducted through the platform may be recorded with participants' consent. Regarding these recordings:
- The user configuring the demo is responsible for informing participants about the recording.
- Recordings are stored securely and retained in accordance with our Privacy Policy.
- Users may request the deletion of recordings at any time.
- Ganima will not use recordings for purposes other than Service delivery without express consent.
7. Service Availability
Ganima strives to maintain continuous Service availability. However, we do not guarantee that access will be uninterrupted or error-free. We may perform:
- Scheduled maintenance, which will be communicated with reasonable notice.
- Updates and improvements to the Service.
- Temporary interruptions due to technical issues or force majeure.
Ganima shall not be liable for losses or damages arising from temporary unavailability of the Service.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available."
- Ganima does not guarantee that the Service will meet all specific user requirements or that results obtained will be accurate or reliable.
- Ganima shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use.
- Ganima's total cumulative liability shall not exceed the amount paid by the user in the 12 months preceding the event giving rise to the claim.
These limitations do not affect consumer rights that cannot be excluded by contract under applicable law.
9. Data Protection
The processing of personal data is governed by our Privacy Policy, available on our Privacy Policy page. By using the Service, you acknowledge that you have read and accepted said policy.
For users who process third-party personal data through the Service, Ganima acts as a data processor in accordance with Article 28 of the GDPR, committing to process data solely in accordance with the user's instructions and to implement appropriate security measures.
10. Duration and Termination
These terms take effect from the moment you access the Service and remain in force for as long as you use it.
Termination by user: you may cancel your account at any time from your profile settings or by contacting contact@tryganima.com.
Termination by Ganima: we reserve the right to suspend or terminate your access to the Service if:
- You breach these Terms of Service.
- Your use of the Service poses a risk to other users or the platform.
- Required by a legal obligation.
Upon termination, your data will be deleted in accordance with our Privacy Policy, except for data we are required to retain by law.
11. Governing Law and Jurisdiction
These Terms of Service are governed by Spanish law and, where applicable, by European Union law. The owner of the Service is Asiron Tech S.L. (Tax ID: B22571525, C/ Nunez de Balboa, 120, 28006 Madrid, Spain), trading as Ganima.
For any dispute arising from the interpretation or application of these terms, the parties submit to the jurisdiction of the Courts of Madrid, unless consumer protection regulations establish another mandatory jurisdiction.
12. Modifications
Ganima reserves the right to modify these Terms of Service at any time. Substantial modifications will be notified to users through the Service or by email with at least 30 days' notice.
Continued use of the Service after modifications take effect constitutes acceptance of the new terms.
